Medical Malpractice Claims Involving Lost Reproductive Choice

Claims sometimes described as wrongful birth can arise when negligent prenatal, genetic, or reproductive health care deprives parents of material information that could have affected an informed decision about conception or pregnancy.

These cases may involve failures in genetic counseling, prenatal screening, diagnostic testing, or communication of significant findings. Whether a viable claim exists depends not only on whether information was missed, but also on whether the provider owed the parents a legally recognized duty, whether the care fell below the applicable medical standard, and whether that failure caused legally compensable harm.

The allegation typically focuses on the parents' loss of informed reproductive choice and resulting harm rather than treating the child's existence or worth as an injury.

Medical Errors That May Affect Reproductive Decision-Making

A missed diagnosis or unexpected congenital condition does not establish medical malpractice by itself. These claims require evidence that a healthcare provider owed an applicable duty, failed to meet the required standard of care, and caused harm recognized under Rhode Island law.

Depending on the circumstances, an investigation may involve allegations such as:

  • Failure to recommend prenatal or preconception genetic screening when medically indicated
  • Failure to order or obtain appropriate diagnostic testing
  • Misinterpretation of prenatal imaging, laboratory, or genetic results
  • Incomplete or inaccurate genetic counseling
  • Failure to communicate abnormal or significant findings
  • Delayed referral for maternal-fetal medicine, genetics, or additional diagnostic evaluation
  • Incorrect information about a known reproductive or genetic risk

The medical timeline may extend from preconception counseling through prenatal care and diagnostic testing. Records can help establish what information was available, which provider was responsible for addressing it, and what the parents were told.

How Rhode Island Courts Analyze Wrongful Birth Allegations

Rhode Island courts have generally approached claims described as wrongful birth through traditional principles of negligence and medical malpractice rather than treating the label itself as a separate source of liability.

That distinction matters. A plaintiff still must establish that the defendant owed a legally recognized duty, that the applicable standard of care was breached, that the breach caused the claimed harm, and that legally compensable damages resulted.

Rhode Island's Supreme Court has also emphasized that duty is not automatic simply because medical information could have affected reproductive decisions. In a 2024 case involving cystic fibrosis, the Court declined to impose a duty on pediatric providers to diagnose a child for the separate purpose of helping the child's biological parents decide whether to conceive another child.

For that reason, evaluating a potential claim requires close attention to who provided the care, who the patient was, the purpose of that care, and the relationship between the alleged medical error and the parents' reproductive decision-making.

Wrongful Birth & Wrongful Life Are Not the Same Claim

The phrase wrongful birth generally refers to a claim asserted by parents arising from alleged negligence that deprived them of information relevant to reproductive decision-making.

Wrongful life refers to a claim asserted on behalf of a child. Rhode Island courts have treated these labels cautiously and have emphasized that the underlying duty, negligence, causation, and legally recognized injury still must be established.

This page addresses potential claims brought by parents. Claims belonging to a child can raise different legal questions.

What Must Be Proven in a Rhode Island Medical Malpractice Case?

Medical malpractice claims involving prenatal or genetic care are highly fact-specific and often require qualified expert testimony.

A legal and medical review generally considers:

  • Duty and standard of care: Whether the provider owed the claimant a legally recognized duty and what competent medical care required under the circumstances.
  • Breach: Whether the provider departed from the applicable standard of care.
  • Causation: Whether the alleged failure deprived the parents of material information and whether the evidence connects that failure to the claimed harm.
  • Damages: Whether the negligence resulted in losses that Rhode Island law allows the parents to recover.

Records, expert opinions, genetic information, imaging, laboratory data, counseling documentation, and evidence concerning the parents' decision-making may all become important.

Filing Deadlines Require Careful Review

Rhode Island medical malpractice claims are generally subject to a three-year statute of limitations under R.I. Gen. Laws § 9-1-14.1.

The statute also includes provisions addressing malpractice that could not reasonably have been discovered when it occurred and claims belonging to minors or other people under legal disability.

Those rules should not be treated as interchangeable. A parent's potential claim and a child's potential claim may involve different accrual dates, duties, and limitation issues. Parents should not assume that a child's age automatically extends the filing deadline for the parents' own medical malpractice claim.

Because the relevant dates may include testing, counseling, pregnancy care, diagnosis, and later discovery of information, prompt legal review is important.

Damages May Include Extraordinary Costs Attributable to the Condition

Rhode Island courts have addressed extraordinary expenses and parental emotional harm in birth-related medical negligence litigation.

Depending on the facts and governing law, a damages evaluation may consider extraordinary expenses associated with a child's congenital condition, including certain medical, therapeutic, educational, residential, equipment, or caregiving needs.

The scope of recoverable damages is case-specific. It may depend on the nature of the provider's duty, the relationship between the negligence and the parents' decision-making, the child's condition, and evidence establishing future needs.

These cases may require medical specialists, life-care planning, financial documentation, and other evidence to distinguish extraordinary condition-related costs from ordinary costs of raising a child.

How We Evaluate a Potential Wrongful Birth Claim

We begin by reconstructing the medical and reproductive-care timeline and identifying which providers were responsible for each stage.

Depending on the circumstances, we may examine:

  • Preconception and prenatal medical records
  • Genetic counseling records
  • Screening and diagnostic test results
  • Ultrasound and imaging reports
  • Maternal-fetal medicine referrals
  • Provider notes and communications
  • Patient portal messages and written instructions
  • Records documenting the congenital diagnosis
  • Medical and financial documentation concerning extraordinary care needs

We can then evaluate whether the facts support further investigation under Rhode Island medical malpractice law.

For families whose concerns involve diagnosis or treatment of a congenital condition rather than the loss of informed reproductive choice, related issues may also fall within our work involving birth defects and congenital conditions.

Free Consultations & No Upfront Legal Fees

We handle medical malpractice matters on a contingency-fee basis. Clients pay no upfront legal fees and owe attorney fees only if we obtain a financial recovery.

Our attorneys provide direct client access and communication throughout the legal process.

A free consultation does not presume that malpractice occurred or that a viable wrongful birth claim exists. It provides an opportunity to review the medical history, identify the providers involved, and determine whether further investigation is appropriate.

Discuss Your Family’s Medical Timeline With Our Attorneys

During a free consultation, we can discuss the screening or testing performed, the information communicated to you, and the congenital condition affecting your family. We represent families throughout Rhode Island, including Providence, and can assess whether the facts warrant further investigation. A consultation doesn’t presume that a viable claim exists.
