Defective and Dangerous Products – Your Rights and Resources

On a daily basis, Americans depend on a host of products to improve their lives.  Everything from our morning coffee, to our medications and our daily commute, involves the use of products.  As consumers, we must be aware of both the benefits and risks of these products.  Typically, the sellers of these products will advise us of the product’s benefits, both measurable (e.g. cheaper, fresher, or longer-lasting) and imaginary (i.e. buy this clothing and you’ll look as good as Brad Pitt or Angelina Jolie).

What is more difficult for consumers to grasp is learning about the risks, if any, relative to a certain product.  Luckily, there are resources available to consumers to learn whether a particular product they own or intend to purchase poses an unsafe risk.  The federal government has multiple agencies dedicated to investigating a particular product’s safety.  For example, if you wanted to learn more about the risks involving your automobile or its tires, the first step would be to explore the National Highway Transportation Safety Administration’s website.  NHTSA maintains a database of consumer complaints, investigations, and recalls regarding automobile and automotive parts.  If you were concerned about a pool, a trampoline, or a smoke detector, you should consider the Consumer Product Safety Commission’s website. You can search the website to learn about recalls and violations regarding a number of everyday consumer products.  Finally, if you have questions or concerns about medical devices or medications, the Food & Drug Administration’s website is a good resource for learning more about what your doctor prescribes. Beyond these governmental resources, a simple Google search may provide additional information about the products you use and risks they may pose.

In the unfortunate event that you or a loved one suffers an injury due to a defective product, feel free to contact the attorneys at Decof, Decof & Barry, P.C. to discuss your case.  The law that holds manufacturers and sellers of defective and dangerous products accountable for the harm they cause is complex and may involve the interplay of both federal and state laws.  Our attorneys have decades of experience navigating through this complex field and reaching successful results for injured persons and their families in a broad range of product liability actions.
