Neil F.X. Kelly

Neil F.X. Kelly joined Decof & Decof in February of 2009 after serving as a lawyer with the Rhode Island Department of Attorney General for almost 18 years. Neil, a former Assistant Attorney General, brings extensive trial and appellate experience dealing with complex litigation in Rhode Island state and federal courts through to the Supreme Court of the United States. He served as prosecutor in the Attorney General’s Criminal Division, and was a member of the Civil Division’s Government Litigation Unit. Neil has been recognized numerous times for his work with the Attorney General.
Significant cases
Since joining Decof & Decof, Neil tried a medical malpractice case against a local hospital where the judgment totaled over $4.5 million after a jury verdict. He was previously lead counsel from the Office of Attorney General on behalf of the State of Rhode Island in its landmark suit against the former manufacturers of lead pigment in Rhode Island v. Lead Industries Association, et al. That case involved the longest civil jury trial in the history of the Rhode Island Superior Court, and resulted in the first jury verdict in favor of a state against the former manufacturers of lead pigment. Neil’s appellate experience is equally as broad involving cases before the Rhode Island Supreme Court, the United States Court of Appeals for the First Circuit, including several before the full court, and the Supreme Court of the United States.
Recognitions
Rhode Island Lawyers Weekly named Neil one of three Lawyers of the Year in 2004 for his work on several high-profile cases, including Rhode Island v. Lead Industries Association, et al. Trial Lawyers for Public Justice recognized Neil along with members of the trial team as Finalists for Trial Lawyer of the Year in 2006 for their work on the case against the former manufacturers of lead pigment. In 2008 and 2009, Neil was named to the Rhode Island Super Lawyers list. Super Lawyers is an annual ranking of not more than five percent of lawyers in a given state based upon peer recognition and professional achievement by an independent review panel. Neil has been recognized by the Childhood Lead Action Project with their Beyond the Call of Duty Award and by the Rhode Island Department of Health for his work toward a healthy environment for children. He has also been recognized by the Town of Narragansett for his contributions to the community as a citizen volunteer.

Neil is a member of the Rhode Island Bar, and is admitted to practice in the U.S. District for the District of Rhode Island, the United States Court of Appeals for the First Circuit and the Supreme Court of the United States.
